I have a hard time believing the State Insurance Commissioner would not "side" with the claimant in this scenario, especially for personal insurance (for a commercial / business policy, there would generally be more expected of the policyholder / claimant).
You may have a point. Even though OP didn't follow the normal process, Progressive instructing the repair shop to charge the comprehensive deductible should infer their acceptance of the claim under comprehensive coverage.
But, as they say, did you get it in writing? This seems all verbal.
OP,did you get any paperwork from the shop showing your copay when you dropped the car off?
Eight hours after dropping the car off the shop sent me a detailed repair estimate. This document clearly shows what Progressive told the shop- that I was expected to pay a deductible of $100 (my deductible for a comprehensive claim).

I went ahead and filed a complaint with the State Corporation Commission of Virginia (state where I live). https://scc.virginia.gov/pages/File-an- ... nt-%281%29
I detailed the timeline starting with the raccoon collision and all documentation I have- including the repair estimate and receipt showing that just a few days after receiving the repair estimate, I had to pay a $500 deductible to get my car back (and will need to pay higher insurance premiums going forward) because the claim was changed to a collision claim at the last moment.
Hopefully the State Corporation Commission of Virginia can help.
So, you do have it in writing. If you're up for the hassle seems like you have the evidence you need to dispute. I'd be ticked off too.
