It's legal so long as the healthier spouse is only covered by one healthcare plan - he can't be enrolled in an HDHP plan and a PPO plan at the same time. He's also not permitted to fund it at the family rate, only as an individual if he were the only one on the plan, so contributions would be cut in half to $4350 or so.Is it legal for the kids to stay on the PPO with one spouse while the other (presumably healthier) spouse enrolls in the HSA and starts socking money away. Maybe cash flow outgoing expenses for some duration?
